No recourse for user whose post is removed under fake news rules: Bombay HC

September 27, 2023 by www.rediff.com Leave a Comment

The Bombay high court on Wednesday said it was troubled by the fact that the recently amended IT Rules to curb online fake news against the government offer no recourse to a person whose social media post has been removed or account suspended after being flagged by the proposed Fact Checking Unit (FCU).

A division bench of Justices Gautam Patel and Neela Gokhale questioned where such a person would go when their post is unilaterally closed with no recourse available.

”It may or may not have a chilling effect but still needs to be considered,” Justice Patel said.

The bench was hearing arguments on a bunch of petitions challenging the amended Information Technology (IT) Rules.

Stand-up comedian Kunal Kamra, the Editors Guild of India and the Association of Indian Magazines have filed petitions in the HC against the Rules, terming them arbitrary and unconstitutional and claiming that they would have a chilling effect on the fundamental rights of citizens.

Solicitor General Tushar Mehta on Wednesday argued that once the FCU, to be set up under the Rules, flags any post with ”fake and false facts” then the intermediaries have the options of verifying it and removing the content or putting a disclaimer on the post.

”The intermediaries retain their safe harbour or immunity by doing so. If the intermediary does nothing then the aggrieved party ( either the person or the government ) can move court against the post and take the intermediary too to court. The court would then decide the liability,” Mehta said.

Mehta clarified that the intermediaries do not have the option of not doing anything once content has been flagged by the FCU. ”The intermediary must act either way to retain their safe harbour or immunity. There is no compulsion to remove but then the intermediary loses its safe harbour,” he said.

The bench then questioned if a remedy was available under the Rules to the person whose post has been flagged.

”If the intermediary complies and removes the content where does the user ( person whose post has been removed or account suspended ) go? There is no recourse for the user. and that is what is troubling us — the user has no recourse, none,” the bench said.

The court also questioned if a government authority, in this case the FCU, has the authority to decide what the truth is.

”What is the truth? We have lower courts to determine this, even courts cannot answer this for sure, courts arrive at some level of truth because there is a process in place. This process has been defined in our system. What lacks here is this process,” Justice Patel said.

The bench noted that it agrees with the Centre’s argument that there are several ”fake and false facts” being spread on the internet and this was a problem not just for the government but also for society at large.

”It raises several serious and ethical questions which can be debated. The only question is the compulsion by the FCU that says it has determined, not a court, but it has determined something is fake and false,” Justice Patel said.

The bench reiterated that although it has been hearing arguments on the issue for several days, one thing that has not yet been clarified by the Union government is what necessitated the amendment now.

”I still don’t get why the Press Information Bureau (PIB), which has until now been doing the job of flagging of fake news on social media platforms, was held insufficient, what warranted this amendment and a FCU, why was the PIB held as inadequate,” the court queried.

Mehta further told the court that the government was not going to be the arbiter on the issue of whether a post contains fake and false facts.

”The government does not seek to be the arbiter. Only the courts can do so,” he said.

The bench will continue hearing the matter on September 29.

In April this year, after the petitions were filed, the Centre had told the court that it would not notify the FCU till July. The statement came to be extended from time to time when the court started hearing arguments in the pleas. Last month, the statement was extended till October 3.

On April 6 this year, the Union government promulgated certain amendments to the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, including a provision for an FCU to flag fake, false or misleading online content related to the government.

The three petitions sought the court to declare the amended Rules unconstitutional and direct the government to restrain from acting against any individual under the Rules.

Man arrested on hospital helipad after two people shot by gunman in ‘combat clothing’

September 28, 2023 by www.dailystar.co.uk Leave a Comment

Police arrested a suspect after a gunman in combat clothing who was at large in Rotterdam shot two people in the Dutch port city.

Reports suggest the two shooting incidents took place at two separate locations in the Netherlands’ second biggest city, after the capital, Amsterdam. De Telegraaf reports that three people have been injured.

A 32-year-old man was arrested on the helideck of the Erasmus Medical Centre, which is in the city centre. Reports state that it is unclear whether the arrested suspect is also the man who was previously wanted.

One incident happened at a house in the west of the city, while the other took place in a classroom of the Erasmus Medical Center.

The man is said to have fled the scene in combat clothing with some outlets reporting that he escaped on a motorcycle.

Cops were checking whether he was inside the EMC in the last hour, and recent reports suggest he was found on the roof.

According to police, he used a handgun for the attacks. They described him as being in his mid-20s, tall, with black hair, and wearing a backpack with headphones. Locals were urged to call police as a matter of urgency if they saw him.

Local media also reported that a fire broke out at another building, where several loud bangs were heard. The cause of the fire is currently unkown and it’s unclear whether anyone was trapped inside.

Dutch security services and a large emergency response, including armed officers and an air ambulance, are at the site of the fire, which is now under control it has been reported.

De Stentor reported that students at Erasmus MC were seen rushing out of the campus with their hands up, without shoes, and many of them were crying. There are unconfirmed reports that one of the victims was a teacher, and that the perpetrator was her husband.

“We just had to run away from the arrest team to behind the school. Something is not right,” one student told the Dutch daily.

There is a similarly large police presence in relation to the shootings, with armed officers seen on the roof of the Erasmus Center – which is the home of Rotterdam’s Erasmus Univeristy’s faculty of medicine.

Authorities will hold a press conference at Rotterdam City Hall at 6:45pm, 7:45pm.

Burglars break into Delhi jewelry shop, flee with ornaments worth Rs 20 cr

September 27, 2023 by www.rediff.com Leave a Comment

At least three unidentified people broke into a jewellery showroom in southeast Delhi’s Bhogal area, made a hole in strong room and decamped with ornaments worth more than Rs 20 crore, the police said on Tuesday.

Image used for representational purpose only.

This is one of the biggest burglaries reported in the national capital.

The shop, Umrao Singh Jewellers, had several CCTV cameras but they were damaged around midnight on Sunday, the police said.

“Police teams reached the spot after we got information on Tuesday at 10.55 am from the shop owner. We have started an investigation into the matter,” said Rajesh Deo, deputy commissioner of police (Southeast).

The incident is expected to have occurred between Sunday night and Monday, police said, adding the store remains closed on Monday.

“The owner closed the shop on Sunday around 8 pm and when he opened it on Tuesday around 10.30 am, he got to know about the incident. There is a safe situated on the ground floor in the shop having a heavy metallic gate and walls on three sides. The dealing with customers takes place on the ground floor of the showroom while its upper three floors are used for stock and repair works.

“When the owner opened the shop, he found that the concrete wall of the safe room has been damaged. The accused made a whole on one side of the wall having dimension of around one to one-and-half foot. Forensic team was called at the spot. The safe will be opened to ascertain the amount of the jewellery stolen,” Deo said.

“Our forensic teams are checking footage captured by CCTV cameras before their wires were cut by the burglars. The accused will be nabbed soon,” the official said.

The shop owner has reported a theft of 30 kg gold jewellery and Rs 5 lakh cash, the DCP said.

A case has been registered at Hazrat Nizamuddin police station and several teams have been constituted to work out the case, he added.

Mahavir Prasad Jain, the shop owner, said that his showroom was around 75 years old.

“Nothing like this happened before. There are six to seven workers in our shop and all are trusted employees. They have been working for the last 20 years. The showroom remains closed on Monday. We locked it on Sunday around 8 pm, opened the shop around 10.30 am on Tuesday and got to know about the burglary.

“There was around Rs 20 crore worth gold and diamond jewellery which was found missing. All six CCTV cameras inside the showroom were found to be unplugged,” Jain said.

The shop has no guard and a common guard of the market gives security during the night hours, he said.

Duler Jain, a relative of the victim, said that the accused came from the terrace. “They broke the lock on the terrace and came downstairs. They took the jewellery from the strong room with them. They also cut the wires of WiFi and CCTV cameras,” he said.

Sources said that the incident took place between 11.30 pm and 12 am on Sunday. The preliminary investigation has suggested that there were at least three people involved in the incident.

The routes of the accused are being ascertained, police said.

Ravinder Taneja, the owner of a nearby building from where it is being suspected that the thieves reached the shop’s terrace, said, “It has a shop on the ground floor while a tuition class is run on the first floor. A person from Kashmir lives on the second floor who comes to the city during winters. The upper floor is vacant.”

“As it is a residential building, no one locks its main entrance,” Tanjea said.

Dilip, who sells slippers near the showroom, said that nobody knew about the incident till Tuesday morning when the owner opened it and found the store burgled.

Ravi, who runs an electronic shop in the area, said it seems that the accused knew about the showroom very well. “The way the burglary has taken place, the thieves must have done some recce before,” he said.

Experts call for fixed, earlier Tet break

September 29, 2023 by e.vnexpress.net Leave a Comment

For many years, the Tet holiday has started one or two days before the new lunar year kicks in and lasted for around one week or nine days if it is included with days as compensation for the weekend.

Every year, the Ministry of Labors, Invalids and Social Affairs would have to make proposals several months before the next new lunar year and wait for feedback from related agencies before submitting the final plan to the government for approval.

Bui Hoai Son, a standing member of the National Assembly’s Culture and Education Committee, said that as the most important holiday of the year and the biggest family reunion occasion of Vietnamese people, it is “late” for the Tet break to start just one or two days before the new lunar year.

He said it would create inefficiency as there is no time for laborers to get prepared, especially those who are migrant laborers, and by that time, not many of them could stay focused on their jobs.

For generations, Vietnamese people have started to get prepared for the Tet holiday from the 23rd day of the final lunar month, or a week before the new year, when they perform a ritual to send the Kitchen Gods back to heaven as a belief that the gods will report everything that has happened in the family to the Jade Emperor over the past year.

“Looking at both aspects of traditional culture and the real-life impacts, it is reasonable for policymakers to change their thinking to make the Tet break start earlier and last longer,” he said.

For this year, the labor ministry last Friday presented a plan with two options for the upcoming Tet break that will fall in February next year.

Both options grant laborers a seven-day break, with one starting one day before Tet and the other two days before.

The ministry is now at the step of collecting feedback from related agencies to complete the plan.

A representative of the Ministry of Transport said when the holiday starts close to the new lunar year, it always causes great pressure on the mass transport system, and passengers always have to pay higher fares.

Assoc. Prof. Dr. Nguyen Duc Loc, Director of the Social Life Research Institute, said that ministries and departments have to sit down to discuss and decide the Tet break every year is “a waste of time and a mere formality,” while business owners need to proactively arrange their production chain.

He said in reality, the implementation of Tet holiday regulations has remained inconsistent as many laborers ask to leave work earlier to return home several days before the break officially starts.

Loc suggested that the Tet break should be fixed every year.

Ha Tat Thang, head of the labor ministry’s Bureau of Work Safety, said it is difficult to fix the break because the Labor Code stipulates only five days of official leave for the Lunar New Year and the ministry has always had to arrange it in a way to add the weekends or compensation days if the five official days fall on the weekends.

He said it is a “principle” for the ministry to ask for opinions from other ministries and departments because the break would affect many agencies and workers.

An online survey by VnExpress of 9,500 respondents last year found that 93% wanted to start the Tet break three days before the new lunar year kicks in.

Vietnam has 11 official days off for holidays and festivals a year. Foreigners working in Vietnam would get an extra day off for their traditional New Year holiday, and another day off for their countries’ National Day holiday.
