Manhattan prosecutors to end cash bail for most low-level cases

Defendants in most low-level cases in Manhattan will be released without bail—a historic change that could reform a system that regularly imprisons poor people for long stretches simply they can’t afford to pay.

The move by Manhattan District Attorney Cyrus Vance to stop asking judges to hold prisoners on bail is part of a national push towards ending imprisonment of misdemeanor suspects simply because they can’t afford bail.

“When non-violent New Yorkers are jailed as a function of their inability to pay, we perpetuate inequality and mass incarceration,” Vance said in a statement on Tuesday. “Beginning today, we will be guided by the presumption that bail is not appropriate for misdemeanor cases.”

Opponents of cash bail say it perpetuates racial bias in incarceration, citing studies that have found judges are more likely to set bail for black and Hispanic suspects than for whites.

Vance’s counterpart in Brooklyn implemented a similar policy last year.

“Bail shouldn’t be requested when we don’t intend to seek jail time and must never be used as leverage to obtain a guilty plea,” Brooklyn District Attorney Eric Gonzalez said in a statement Tuesday.

Two U.S. senators are leading a bipartisan effort to encourage states to reform or replace their bail systems. Kamala Harris, a Democrat from California, and Rand Paul, a Kentucky Republican, wrote in a New York Times op-ed last year that the U.S. justice system fails to treat all people equally if 450,000 Americans are in jail awaiting trial because they can’t afford bail.

Reforms to cash bail systems have also been made in New Mexico, Chicago and New Jersey, where the number of defendants awaiting trial in jail dropped by 20 percent.

But such reforms don’t guarantee complete success.

Maryland prosecutors began reducing their requests for cash bail last year, but students at the University of Maryland law school said last month that the 16 defendants they were representing were denied bail or faced bail amounts they couldn’t afford.

“This included Kevin, 18, who was held on $200 bail for a $15 theft; Tina, 52, who was held on a $300 bond on drug charges; and George, 67, who was held on a $750 bond also on drug possession charges,” the students wrote in the Baltimore Sun last month.

At least one New York defense attorney was similarly pessimistic about how the Manhattan announcement would play out in court.

“I think after my case is done I’ll pop on in to the arraignment part and see if this is true,” Ken Womble, a criminal defense attorney in New York City, tweeted in response to the news. “I’m less than optimistic.”

The Manhattan DA’s office will still ask for bail in some cases, including those involving violence or sex crimes and those in which the defendant has been convicted of felonies or is on parole or probation.

Kalief Browder, a Bronx teenager who was held on New York City’s Rikers Island without trial for three years on $3,000 bail without trial after he was arrested for stealing a backpack, was the most high-profile prisoner held on low bail in recent years. The charges against Browder were eventually dismissed in 2013, but he later committed suicide.

Before his death, Browder said that his long imprisonment was responsible for his mental illness. “Prior to going to jail, I never had any mental illnesses,” Browder told HLN in 2013. “I never tried to hurt myself, I never tried to kill myself, I never had any thoughts like that.”

Employers’ group does not see possibility of raising Alert Level 2 in NCR

MANILA, Philippines — An employers’ group does not see the possibility of heightening the alert status in Metro Manila to Level 2 amid the rise in COVID-19 cases.

Employers Confederation of the Philippines president Sergio Ortiz-Luis was asked in a Laging Handa public briefing what the effects are of a possible Alert Level 2 on the business community.

“Well, actually, I don’t see any possibility naman (that), well, in the probability that alert level [will be increased],” he replied.

“Ako, medyo naano nga kami sa business community na bakit may mga taong ayaw matanggap na tayo ay magno-normalize na. At every time na mayroong lalabas na ano eh gumagawa sila ng istorya na nakaka-panic,” he added.

(We in the business community were baffled why there are people who cannot accept that we are normalizing. Every time, they make stories that cause panic.)

According to Ortiz-Luis, the economy will further sink if workers would be prohibited anew to going to offices.

He lamented that the government cannot provide aid for the individuals who will be affected by stricter restrictions.

“Bakit hindi natin matanggap na talaga tayo ay nagno-normalize at lagi na lang may naiisip na problema na milyun-milyon na naman na hindi naman kaya ng gobyerno nating ayuda kapag ginawa natin iyan,” he questioned.

(Why cannot we accept that we are normalizing? The government cannot provide aid to people when we raise the alert level.)

Ortiz-Luis also said that the COVID-19 situation in the country is gearing towards the endemic level .

Health Undersecretary Maria Rosario Vergeire earlier raised the possibility of hoisting Alert Level 2 in Metro Manila due to an uptick in COVID-19 cases.

Xander Schauffele’s level of play shows the burden of expectations from being a top 10 player in the world

What to make of Xander Schauffele? It’s been one of the questions in and around golf — specifically on the PGA Tour — over the last three years, and it’s often been a query that has had no great answers.

Schauffele is an impressive talent who doesn’t win very often compared to his peers. What do you do with that? How do you think about that?

He’s been ranked inside the top 15 in the Official World Golf Rankings every week since he won the WGC-HSBC Champions late in October 2018 since breaking into that top 15 in the world for good. That’s 44 consecutive months as a top 15 player in the world, and until Sunday’s victory at the Travelers Championship , he had just one individual PGA Tour victory in that span of time, a come-from-behind win at the January 2019 Tournament of Champions.

Since then, he added an Olympic gold medal in a — to put it kindly — mediocre field in Japan as well as a Zurich Classic team win earlier this year when he partnered with his vacation pal, Patrick Cantlay. The former doesn’t count on the PGA Tour, the latter doesn’t count in the Official World Golf Rankings. Neither counts as an individual PGA Tour victory.

Schauffele’s two-stroke win over Sahith Theegala and J.T. Poston this weekend was a big deal. Not just because he did it in a low-key good field (14th-best field in the world so far in 2022), but also because he hadn’t done it in so long.

“I like to talk to my team a lot about how I’m feeling week to week,” Schauffele said after his win. “It’s been a year where my stats have been very solid. Just haven’t really put in four good rounds of golf. So I think subconsciously — or without myself even really knowing — I was getting a little impatient. This week I was just trying to be as aware, self-aware as possible to just stay as patient as possible. Just realize that I put the work in, and if I can just sort of do what I’ve been doing and just focus a little bit more throughout the day that it will pay off in a big way and fortunately it did.”

It’s not just the Official World Golf Rankings where Schauffele has thrived. He is ranked No. 5 in the world in total strokes gained since the start of 2019, which implies that a lack of winning is not just a function of him maxing out the ceiling of his talent. He’s not necessarily squeezing the greatest results from a subpar game. According to the numbers, his talent is equivalent to — and in some cases greater than — that of his peers.

Others who hang out in that strokes gained neighborhood have won in bunches. Golfers like Jon Rahm (eight wins, albeit one at a team event), Rory McIlroy (seven wins), Justin Thomas (six wins), Cantlay (six wins, one at a team event), Dustin Johnson (seven wins), Hideki Matsuyama (four wins), Viktor Hovland (six wins), Scottie Scheffler (seven wins) and Collin Morikawa (six wins) surround Schauffele in the top 10 in strokes gained since the start of 2019.

Schauffele’s closest comparison is probably Webb Simpson, who ranks just behind him in total strokes gained in that period of time. But his game is far less well-rounded than the rest. He has just two wins since Jan. 1, 2019, but he also has maybe the biggest categorical deficiency — strokes gained off the tee — of anybody in the top 10 in strokes gained. Schauffle, on the other hand, is in the top 30 in every strokes gained category over the last three and a half years.

Perhaps, like Tony Finau (17th in strokes gained since the start of 2019), Schauffele is a victim of his own statistical success. If he was objectively worse at golf, nobody would care that he doesn’t win as often as the other top 10 players in the world. However, there is certainly a burden of expectation when you never fall out of the top 10 or top 15. It’s clear that you have the talent of the top players, but you never cash it in. That can lead to some wondering if you have what it takes to close out wins. That might sound unfair, but the light on a top 10 player in the world is harsh.

Take a look at these numbers below. Before Sunday, Schauffele ranked 10th on this list with a winning percentage of 3.6%, and that included a shadow leaderboard win at the 2020 Tour Championship, which the OWGR awards based on actual score at the event and not based on starting strokes (which the PGA Tour recognizes). Rahm, too, is given credit for a shadow leaderboard win, but that victory affects his overall winning percentage a lot less than Schauffele (without it, Schauffele would drop to a career 3.0% winning percentage, 11th on this list).

While it’s true that Schauffele was not the wunderkind in high school and college that guys like Thomas, McIlroy and Rahm were, we’re also not comparing him to his younger self, we’re comparing him to the very best players on the planet, which is now what he is.

“I think to win more,” Schauffele said of his goals the rest of this season. “But I really think this was like, in a small way, this is a big win for me mentally. Just because I sort of had to check myself, you know what I mean? When you’ve been out here and things are going easy you just expect to play well all the time. Sometimes it’s good to take a step back. And I thought I did that this week.

“Like I said, I don’t know if that’s the reason I won, but it definitely made me feel more comfortable and helped my process throughout the week.”

That Xander Schauffle has not won as much as his talent has implied that he should — a level of talent that others have capitalized on shown by their own trophy cases — sounds like a criticism, and perhaps in some ways it is. However, it’s meant to be less of a nod to the level of talent he has and the burden of expectations every great player shoulders and should want.

If little is expected of you, if you’re not critiqued for how little you win, then it means you’re inconsequential to the game at the highest level. You don’t have the tools to be among the greats. That’s not Schauffele, and it hasn’t been in a long time. With a win at the Travelers, his march toward cashing in that talent with more and more victories in the future has resumed. Sunday was a big victory in the micro sense that the Travelers is a great tournament, but it was perhaps a bigger victory in the macro for one of the top golfers in the world.

India, Malaysia Defence Minister-level talks focus on LCA and Su30 MKM fleet

It is learnt that the Indian offer for 18 of the Tejas fighter jets to meet a Malaysian requirement was discussed at length. As reported, India has offered a dual package for the indigenous fighter jets as well as maintenance of the Su30 MKM aircraft being operated by Malaysia.

India and Malaysia held top defence-level talks on Monday, with a focus on the Tejas Light Combat Aircraft ( LCA ) offer as well as sustenance of the Russian origin Su30 MKM fleet of the Malaysian Air Force . The talks took place via video conferencing between defence minister Rajnath Singh and Malaysia’s senior defence minister YB Dato ‘Seri HishammuddinTun Hussein.

It is learnt that the Indian offer for 18 of the Tejas fighter jets to meet a Malaysian requirement was discussed at length. As reported, India has offered a dual package for the indigenous fighter jets as well as maintenance of the Su30 MKM aircraft being operated by Malaysia.

While several rounds of technical discussions on the Indian aircraft have already taken place with the Tejas emerging as the frontrunner in a competition with South Korean and Chinese origin jets, a government-to-government deal could also be in the offing.

“The defence minister highlighted the areas in which Indian defence industries could assist Malaysia. He suggested a visit of senior officers from Malaysia to India to get a first-hand experience of the facilities and products of the Indian defence industry,” the Indian defence ministry spokesperson said.

Singh also extended an invitation to Hussein to visit India at an early convenient date to discuss closer and strategic defence ties. “A wide range of issues concerning bilateral, regional and defence industrial cooperation were discussed during the meeting,” said the spokesperson.

The Indian offer of an attractive financial package for its Tejas and commitment to keep Malaysia’s fleet of Su30 jets flightworthy, has placed it as a frontrunner for a Malaysian competition to acquire new combat aircraft. Other contenders for the deal are unable to offer this package as they do not have backend contracts with Russian manufacturers to work on the Sukhois.

The Malaysian air force has been looking for 18 new light fighter jets with several nations, including South Korea, Pakistan, China and Sweden, making a pitch. The Indian offer is for the LCA Mk1A version, 83 of which are on order by the Indian Air force. The aircraft is equipped with a modern AESA radar, latest avionics and the capability to integrate a variety of western as well as Russian-origin air-to-air and air-to-ground weapons. India also has the indigenous Astra beyond visual range air-to-air missile that will be integrated on the fighter.

HDIL Case: ED summons Shiv Sena MP Sanjay Raut on Tuesday

The Rajya Sabha MP has been asked to depose before the federal agency at its office in south Mumbai on June 28 and record his statement under the Prevention of Money Laundering Act (PMLA), they said.

Amid the political crisis in Maharashtra ,the Enforcement Directorate (ED) has summoned Shiv Sena MP and senior politician Sanjay Raut in a money laundering case, sources in the know told ET.

According to these sources Raut has been asked to present himself before the agency’s Ballard Pier office in Mumbai at 11am. Raut and his wife, Varsha are being probed by the central agency in connection with its probe into a money laundering case against jailed HDIL promoters, Rakesh and Sarang Wadhawan. The agency has allegedly tracked certain transactions linked to Raut’s wife, Varsha.

According to the agency, investigation conducted so far revealed that around Rs 100 Crore were transferred from HDIL to the account of the arrested accused, Pravin Raut. The probe has revealed that during 2010 part of the alleged proceeds of crime amounting to Rs 83 lakhs was received by Varsha Raut, wife of Sanjay Raut directly/ indirectly from Madhuri, wife of Pravin Raut. This amount was allegedly utlised by Raut for purchase of a flat in Dadar. It is also revealed that after initiation of ED investigation the amount of Rs 55 Lakhs was transferred by Raut to Madhuri Raut. The ED has attached the flat and 8 land parcels in Alibaug, a getaway on the outskirts of Mumbai.

The MVA government in the state has been hit by a crisis after a faction of Shiv Sena leaders headed by Eknath Shinde left the party putting the party and the government in the state on a sticky wicket.

Raut was not immediately available for a comment.

Earlier this year, ED had provisionally attached properties linked to Shiv Sena MP including a flat in central Mumbai, eight land parcels in Alibaug, a getaway on the outskirts of Mumbai owned by Raut’s family members.

Incidentally Raut has levelled allegations of extortion against Mumbai-based ED officials. Acting on the same, Tuesday the state government constituted a special investigation team (SIT) headed by a DIG-rank officer to investigate the matter.

The federal agency is probing a case under the Prevention of Money Laundering (PMLA) relating to irregularities in redevelopment of Patrachawal, a real estate project in suburban Mumbai by Guru Ashish Construction Pvt Ltd.

“The attached assets are in form of lands held by Pravin M Raut, former director of Guru Ashish Construction Pvt Ltd, Mumbai at Palghar, Saphale, padga , flat at Dadar of Varsha Raut and plots at Kihim beach at Alibaug jointly held by Varsha Raut wife of Sanjay Raut and Swapna Patkar wife of Sujit Patkar,” the ED said in a statement earlier.

Investigation under PMLA revealed that M/s Guru Ashish Construction Pvt. Ltd was entrusted with the development of Patra Chawl Project for rehabilitation of 672 tenants. During the relevant time Rakesh Kumar Wadhawan, Sarang Wadhwan of HDIL and Pravin Raut were the Directors of M/s Guru Ashish Construction Pvt Ltd.

A tripartite agreement was signed between society, MHADA and Guru Ashish Construction Pvt Ltd. According to the agreement, the developer was to provide the flats to 672 tenants and develop flats for MHADA and thereafter the remaining area to be sold by the developer. The directors of Guru Ashish Constructions misled MHADA and managed to sell the FSI to 9 developers and collected approx. Rs 901.79 Crore without constructing the rehab portion for 672 displaced tenants and MHADA portion. Further Guru Ashish Construction Pvt. Ltd have also launched one project namely Meadows and took the booking of amount around Rs 138 Crore from flat buyers. The total proceeds of the crime generated by Directors of Guru Ashish Constructions Pvt. Ltd through the illegal activities were approx. Rs 1039.79 crore, the ED findings revealed.

“The part of the proceeds of crime was further transferred to close associates. Money trail investigation conducted so far revealed that around Rs 100 Crore were transferred from HDIL to the account of Pravin Raut. This amount was further diverted by Pravin Raut to various accounts of his close associates, family members, his business entities etc. It is also revealed that during 2010 part of the proceeds of crime amounting to Rs 83 lakhs was received by Varsha Raut wife of Sanjay Raut directly/ indirectly from Madhuri Pravin Raut wife of Pravin Raut. This amount was utilized by Varsha Raut for purchase of a flat at Dadar. It is also revealed that after initiation of ED investigation the amount of Rs 55 Lakhs was transferred by Raut to Mrs Madhuri Raut. There are also various other transactions,”the statement read.

“Eight plots of land at Kihim beach at Alibaug were also purchased in the name of Varsha Raut and Swapna Patkar, wife of Sujit Patkar a close associate of Sanjay Raut. In this land deal apart from the registered value ,cash payments were made to the sellers,”the statement added.

The ED in February arrested Pravin Raut in the said case.
